These Terms of Use ("Terms") govern your access to and use of the "Hufrehe Alarm" (Laminitis Alarm) mobile application (the "App"), provided by Hufguru UG (haftungsbeschränkt) ("we," "us," or "our"). By accessing or using the App, you signify that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and the Factual Information on the Use of the AI-Powered Analysis. If you do not agree with these Terms, you must not use the App.

These Terms supplement any terms and conditions imposed by the respective App Store providers (e.g., Google Play Store, Apple App Store).

1. Nature of the App and Services (Non-Medical/Veterinary Device Disclaimer)

The Hufrehe Alarm App is a monitoring and informational tool designed to assist horse owners, farriers, and veterinarians in the structured observation and documentation of hoof-related changes. The App provides AI-supported analysis of hoof images to support general hoof health awareness and early detection of mechanical stress indicators. It also offers informational content, an interactive map of partners, and a community forum.

IMPORTANT NOTICE: THE HUFREHE ALARM APP IS NOT A MEDICAL DEVICE, VETERINARY MEDICAL DEVICE, OR DIAGNOSTIC TOOL. IT DOES NOT PROVIDE MEDICAL, VETERINARY, DIAGNOSTIC, OR THERAPEUTIC ADVICE, NOR DOES IT REPLACE PROFESSIONAL VETERINARY EXAMINATION, DIAGNOSIS, OR TREATMENT BY A LICENSED VETERINARIAN OR QUALIFIED HOOF SPECIALIST.

• The App exclusively analyzes mechanical load and hoof shape based on user-provided images. It is crucial to understand that this represents only one partial risk factor in the development of laminitis.
• The App does not evaluate metabolic, nutritional, or management-related risk factors, nor does it consider inflammatory, infectious, or systemic causes of laminitis or other hoof conditions.
• All analyses and information provided by the App are for informational and monitoring purposes only and do not constitute a medical or veterinary diagnosis.
• You must never disregard professional veterinary advice or delay seeking it because of information provided by the App. Always consult with a licensed veterinarian or qualified hoof specialist for any health concerns regarding your horse.

2. User Account and Responsibilities

To use certain features of the App, you may be required to create a user account. You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the confidentiality of your account password and notify us immediately of any unauthorized use of your account.
• Be solely responsible for all activities that occur under your account.
• Ensure that any content you upload (e.g., hoof photos) is lawful, does not infringe on third-party rights, and complies with these Terms.

3. Intellectual Property Rights

All content, trademarks, service marks, trade names, logos, and other intellectual property displayed on or through the App are owned by Hufguru UG (haftungsbeschränkt) or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, distribute, modify, or create derivative works of any content without our prior written consent.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HUFGURU UG (HAFTUNGSBESCHRÄNKT) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (C) ANY CONTENT OBTAINED FROM THE APP; AND (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

• We are liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health.
• In cases of slight negligence, we shall only be liable for the breach of a material contractual obligation (cardinal obligation). In such cases, our liability is limited to the damage typically foreseeable at the time of concluding the contract.
• We assume no liability for the accuracy, completeness, or timeliness of the information provided by the App, nor for any damages arising from the use or incorrect interpretation of the AI analysis, health damages to the animal, economic losses, or indirect/consequential damages. 
• No liability is assumed for the App’s ability to prevent, improve, or correctly detect laminitis or any other hoof condition.

TO THE MAXIMUM EXTENT PERMITTED BY THE APPLICABLE LAW OF YOUR HOME JURISDICTION, THE PROVIDER’S LIABILITY FOR ANY DAMAGES ARISING FROM THE USE OF THE APP, THE AI ANALYSIS, OR ANY RELATED SERVICES IS EXPRESSLY EXCLUDED. IF THE APPLICABLE LOCAL CONSUMER PROTECTION LAW OF YOUR HOME COUNTRY MANDATORILY RESTRICTS THE TOTAL EXCLUSION OF LIABILITY, THE PROVIDER’S LIABILITY SHALL BE LIMITED TO THE MINIMUM AMOUNT ALLOWED BY SUCH LOCAL LAW, OR TO THE AMOUNT YOU PAID TO USE THE APP, WHICHEVER IS LOWER.

5. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law principles. If you are a consumer, this choice of law shall only apply to the extent that it does not deprive you of the protection afforded by mandatory provisions of the laws of the country in which you have your habitual residence (e.g., EU Member States, UK, or countries in Latin America).

For any disputes arising out of or in connection with these Terms, the courts of Germany shall have exclusive jurisdiction, unless mandatory consumer protection laws in your country of residence provide for alternative jurisdiction.

6. Changes to the Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after such modifications constitutes your acceptance of the revised Terms.
